RULES OF CONDUCT FOR VISITORS TO THE CITY CENTER SHOPPING AND ENTERTAINMENT CENTER
1. Subject and purpose of the Rules.
• The Rules of Conduct for Visitors to the City Center Shopping and Entertainment Center (hereinafter referred to as the “Rules”) are approved corporate rules that are mandatory for all persons who are on the territory of the City Center Shopping and Entertainment Center, located at: Mykolaiv Region, Mykolaiv, Centralny Ave., 98, including in the premises intended for use and visit by all users and visitors, including, but not limited to, entrances and exits to the City Center Shopping and Entertainment Center, corridors, halls, toilets, passages, elevators, escalators, parking lots and places for parking vehicles (hereinafter referred to as “Common Areas”).
• By entering the territory of the City Center shopping mall, visitors confirm that they have read these Rules and their obligations to comply with the requirements stipulated by the Rules, and also assume full responsibility for violation of such rules and the consequences of such violation.
• The owner and administration of the City Center shopping mall are exempt from liability for any damage caused to or by a person as a result of violation of these Rules.
2. General provisions.
• All relations between the City Center shopping mall and business entities that carry out economic activities on the territory of the City Center shopping mall are regulated by relevant agreements between the City Center shopping mall and such business entities, as well as by the current legislation of Ukraine.
• The operating hours of the City Center shopping mall for business entities that carry out economic activities on the territory of the City Center shopping mall are set: from 10 (ten) hours 00 (zero zero) minutes to 20 (twenty) hours 00 (zero zero) minutes (for the hypermarket - from 08 (eight) hours 30 (thirty) minutes to 23 (twenty-three) hours 00 (zero zero) minutes; (for the catering area and cinema - from 10 (ten) hours 00 (zero zero) minutes to 24 (twenty-four) hours 00 (zero zero) minutes) daily
• City Center Shopping Mall is not responsible for the quality of goods, works and services sold (provided) by business entities, and for the safety of property of visitors to City Center Shopping Mall (including property located in the surrounding area).
• For the safety of visitors, open video recording is carried out on the territory of the City Center shopping mall.
3. Rights and obligations of visitors to the City Center shopping mall.
Visitors to the City Center shopping mall have the right to:
• Use the services that are implemented (provided) on the territory of the City Center shopping mall (for paid services - subject to payment).
• Drink alcoholic beverages exclusively in the catering area, provided that such beverages are purchased at a catering establishment located in the catering area.
• Move freely around the City Center shopping mall, with the exception of access to utility and technical rooms.
• Get access to information about the list of services that are implemented (provided) on the territory of the City Center shopping mall both by the City Center shopping mall itself and by business entities that carry out economic activities on the territory of the City Center shopping mall.
• To familiarize yourself with these Rules and receive clarifications regarding their content from the employees of the City Center shopping mall.
Visitors to the City Center shopping mall are obliged:
• Follow these Rules while staying at the City Center shopping mall.
• Treat with respect persons who are visitors or employees of the City Center shopping mall, as well as persons who carry out business activities on the territory of the City Center shopping mall.
• Follow the rules for using escalators (the rules are posted on the side wall of each escalator and are designed to ensure the safety of citizens and are mandatory for all escalator users).
• Observe safe passage through the automatic doors located at the entrance groups of the City Center shopping mall, taking into account that the radar sensor installed on the automatic doors responds to any movement only in front of the door.
4. Rules of stay at the City Center shopping mall.
The following is not allowed in the City Center shopping mall:
• to conduct business activities in the premises and parking area of the City Center shopping mall without concluding a relevant agreement with the City Center shopping mall, including distributing advertising and information materials regardless of the content of the latter;
• to be on the territory of the City Center shopping mall with dogs and other pets, except for cases when such animals are transported by visitors in special closed boxes (containers) or in the hands of the owner (for indoor and decorative dog breeds), provided that the animals do not pose a threat to the life, health and property of other visitors;
• ride rollerblades, jumpers, skateboards, scooters, bicycles and other mobile and transport vehicles on the territory of the City Center shopping mall, including using shopping carts for goods for other than their intended purpose. In addition to the above, it is unacceptable to be on the territory of the City Center shopping mall with bicycles and scooters (outside the parking area). Exceptions to the Rules are established for areas specially designated for this (ice rinks, gyms, etc.);
• play games using sports equipment (balls, rackets, etc.), which interferes with the comfortable stay of other visitors in the City Center shopping mall. Exceptions to the Rules are established for areas specially designated for this purpose (ice rinks, gyms, etc.);
• drink alcoholic beverages and eat outside of restaurants or cafes and/or be in the City Center shopping mall and in the City Center shopping mall parking lot in a state of alcoholic, narcotic or toxic intoxication, when signs of such a condition create inconvenience for other visitors to the City Center shopping mall;
• to be in the territory of the City Center shopping mall wearing clothing that may soil or damage the property of the City Center shopping mall, other visitors or persons carrying out business activities in the territory of the City Center shopping mall;
• use sound amplification devices (loudspeakers) on the territory of the City Center shopping mall without the consent of the City Center shopping mall;
• damage property, the City Center shopping mall, other visitors or persons carrying out business activities on the territory of the City Center shopping mall;
• use open flames or pyrotechnics;
• smoke in the City Center shopping mall (including electronic cigarettes, IQOS, vapes) or outside specially designated areas in the area adjacent to the City Center shopping mall;
• bring flammable, poisonous, potent substances or substances with a sharp unpleasant odor into the territory of the City Center shopping mall;
• use the City Center shopping mall parking lot for driving lessons and motorsports, or other activities that pose a threat to visitors and their property;
• use the City Center shopping mall parking lot for parking vehicles for more than 11 hours a day, dropping off and picking up passengers, selling goods/works/services in the City Center shopping mall parking lot without the prior written consent of the City Center shopping mall administration;
• to gamble both for material values (money, things, etc.) and without involving the latter;
• move around the City Center shopping mall with drinks in open containers (including disposable ones). Run, play outdoor games, laugh loudly, dance, etc., as well as perform other actions in the Common Areas that disrupt order and may interfere with the comfortable stay of other visitors and tenants of the City Center shopping mall;
• violate the established rules for using the equipment and staying on the rink;
5. Other provisions and consequences of violating the Rules.
• Children under the age of 12 are prohibited from staying in the City Center shopping mall without being accompanied by their parents or a person who is personally responsible for such a child.
• In accordance with Article 20-1 of the Law of Ukraine "On the Protection of Childhood", from 22 (twenty-two) hours 00 (zero) minutes to 06 (six) hours 00 (zero zero) minutes on the territory of the City Center shopping mall it is prohibited for persons under the age of 16 to be present without being accompanied by a parent or a person who bears personal responsibility for the minor.
• In case of violation of the terms of these Rules, employees of the City Center shopping mall or its authorized representatives, after issuing a verbal warning about the inadmissibility of violating the Rules, have the right to prevent such a person from entering the territory of the City Center shopping mall or remove him from the territory of the City Center shopping mall in compliance with the procedure established by Articles 12 and 13 of the Law of Ukraine "On Security Activities".
ADDENDUM No. 1 TO THE RULES OF CONDUCT OF VISITORS TO THE CITY CENTER SHOPPING AND ENTERTAINMENT CENTER
(taking into account the military aggression of the Russian Federation against Ukraine and martial law in force throughout the territory of Ukraine from 05:30 on 02/24/2022 in accordance with the Decree of the President of Ukraine No. 64/2022 “On the Introduction of Martial Law in Ukraine”, approved by the Verkhovna Rada of Ukraine)
1. General Provisions
• These Supplements (hereinafter referred to as the “Supplement to the Rules” or “Supplement”) to the Rules of Conduct for Visitors of the City Center Shopping and Entertainment Center have been developed and approved by the administration of the City Center Shopping and Entertainment Center in the event of an “AIR ALARM” alert signal.
• The amendments to the Rules are mandatory for all persons staying on the territory of the City Center Shopping and Entertainment Center, located at: Mykolaiv region, Centralny Ave., 98 (hereinafter referred to as the “City Center Shopping Center”).
• In the event of an "AIR ALARM" alert, all persons present in the City Center shopping mall (visitors, employees of tenants, etc.) must to:
- without panic, without creating a crowd, urgently leave the City Center shopping mall building;
- follow to shelters (protective structures), in particular the closest to the City Center shopping mall storage or other safe shelters, the list of which is published by city authorities.
2. Final provisions and validity period of the Amendments to the Rules
• These Supplements are an integral part of the Rules.
• The owner and administration of the City Center shopping mall are not responsible for any damage caused to a person (life, health, property of such a person) resulting from such person's violation of these Supplements to the Rules and/or military actions.
• These Supplements to the Rules shall enter into force on "01" March 2022 and shall remain in effect for the duration of the Rules.
ADDENDUM No. 2 TO THE RULES OF CONDUCT OF VISITORS TO THE CITY CENTER SHOPPING AND ENTERTAINMENT CENTER
1. General Provisions
• These Supplements (hereinafter referred to as “Supplement to the Rules No. 2” or “Supplement No. 2”) to the Rules of Conduct for Visitors of the City Center Shopping and Entertainment Center establish additional mandatory requirements for visitors regarding compliance with public order, safety, and rules of proper conduct on the territory of the shopping center.
• The amendments to the Rules are mandatory for all persons staying on the territory of the City Center Shopping and Entertainment Center, located at: Mykolaiv Region, Centralny Ave., 98 (hereinafter referred to as “City Center Shopping Center”, “Shopping Center”).
• Visitors are obliged to behave in such a way as not to create obstacles for other visitors and employees, not to disturb public order, not to damage the property of the shopping center, tenants or third parties, and also to comply with the legal requirements of the shopping center administration and security service aimed at ensuring order, safety, preservation of property and prevention of offenses.
• Visitors to the shopping center are prohibited from engaging in actions that disrupt public order or may be considered aggressive, insolent, or dangerous. Such actions include, in particular, insults, threats, provoking conflicts, fights, harassment of visitors or employees, as well as any behavior that creates a reasonable feeling of danger or discomfort among those present.
• It is prohibited to intentionally or negligently damage, spoil or pollute the property of the shopping center, the property of tenants or third parties, including decoration elements, glass structures, walls, floors, ceilings, furniture, display cases, equipment, navigation aids, fire safety systems, utility networks, elevators, escalators and other infrastructure facilities. It is prohibited to apply inscriptions, drawings, stickers, graffiti, mark surfaces, post advertisements or other materials without the written permission of the shopping center administration.
• It is prohibited to perform actions that pose a threat to the life, health or safety of other persons. In particular, it is prohibited to throw, drop or move from floors, stairs, balconies, bottles, objects or other things that may cause injury or damage to property; to run in areas with intensive movement of people, on escalators and stairs; to perform actions that may cause a stampede; to block passages, entrances/exits, evacuation routes; to touch, open or use fire safety system equipment without absolute necessity; to unreasonably turn on the fire alarm, take, move, hide or use fire extinguishers or other fire extinguishing means.
• It is prohibited to be in the territory of the shopping mall in a state of alcoholic, narcotic or other intoxication, as well as to perform actions that indicate possible intoxication or loss of control over behavior. It is prohibited to drink alcoholic beverages outside the premises of establishments that have the right to the relevant type of activity, as well as any actions that create risks for visitors or employees. An exception may be being intoxicated in the shopping mall when leaving the catering establishment and passing through the territory of the shopping mall in order to move to the street, provided that the signs of such a state do not create inconvenience for other visitors to the City Center shopping mall and / or do not give rise to a violation of the Rules of Conduct for visitors to the City Center shopping mall.
• It is prohibited to ignore or fail to comply with the legal requirements of the security service and the SEC administration aimed at stopping violations, preventing a dangerous situation, ensuring public order, preserving property and safety. The visitor is obliged, at the request of the security service or administration, to stop the violations, refrain from dangerous actions, provide an opportunity to go to a safe zone, and also leave the SEC territory if the SEC administration makes a corresponding decision.
• In case of violation of these Rules, the administration of the shopping mall and/or the security service have the right to take the necessary response measures to immediately stop the violation and prevent its recurrence. Such measures include a verbal warning, a requirement to immediately cease the violation, a requirement to leave the territory of the shopping mall, refusal of admission to the shopping mall, and a ban on further visits to the shopping mall. The decision to refuse admission or ban on further visits is made by the shopping mall administration / shopping mall security, taking into account the nature of the violation, its recurrence, consequences for safety and property, and the risk of repeated offenses.
• If the violation has the characteristics of an administrative/criminal offense, poses a threat to life and health, is accompanied by damage or theft of property, or if the violator refuses to comply with the lawful requirements of the security service/administration, the SEC administration and/or security service have the right to call the National Police of Ukraine and ensure the preservation of video surveillance materials for transfer to law enforcement agencies in accordance with the established procedure.
2. Final provisions and validity period of Amendment No. 2 to the Rules
• These Supplement No. 2 are an integral part of the Rules.
• The data of Supplement No. 2 to the Rules shall come into force on January 23, 2026 and shall be valid for the duration of the Rules and shall be brought to the attention of visitors by posting information on the information stands of the shopping mall and/or on the official website, as well as in abbreviated form as an announcement in public areas.
